Agreement
These Terms of Service (“Terms”) apply to your use of the Diamond Pool Cleaning & Repair (“Diamond Pool,” “we,” “us,” or “our”) website and to the pool cleaning, repair, and related services we provide to residential customers in Cave Creek, Carefree, Anthem, and surrounding areas of Arizona. By using our website or hiring us, you agree to these Terms.
Services we provide
We offer weekly pool cleaning, equipment repair and installation, green pool recovery, and related residential pool care. Scope, frequency, and pricing for recurring service are confirmed with you before we start. One-time work is confirmed by phone, text, or email before it is performed.
Scheduling, access, and safety
We do our best to service your pool on the same day each week. Weather, road conditions, safety concerns, or circumstances outside our control may shift a visit by a day. When that happens, we complete the visit that same week whenever possible.
You are responsible for providing safe, unlocked access to the pool and equipment on your scheduled day, keeping pets secured, and letting us know about hazards (loose gates, aggressive dogs, construction, etc.). If we cannot safely access the pool, we will contact you and reschedule; the visit may still be billed.
Water chemistry and pool condition
We balance water chemistry using standard industry practices for the Arizona desert. Some conditions (algae blooms, calcium scaling, stains, aging plaster, heavy debris after storms, or extended neglect before service began) can take additional time, chemicals, or specialized treatment to resolve, which may be billed separately with your approval.
Recurring service does not include draining, acid washing, tile cleaning, filter rebuilds, or major repairs unless separately quoted and agreed to.
Equipment repair and parts
For repair work, we diagnose the issue, recommend a course of action, and confirm pricing before starting. Parts we install carry their manufacturer’s warranty. Our labor is warrantied for 30 days on the specific work performed unless we agree in writing to a different period. Warranty does not cover damage caused by misuse, power surges, freezing, chemistry imbalance created outside our service, or work performed by others after us.
Pricing, billing, and payment
Recurring service is billed monthly. Chemicals used above the standard allowance, additional labor, and any approved repairs are itemized. Invoices are due on receipt unless otherwise agreed. Late or unpaid balances may result in a pause of service until the account is current.
We accept the payment methods listed on your invoice. Returned payments may incur a fee equal to the amount charged by our bank or processor.
Cancellation
You can cancel recurring service at any time by contacting us at least 7 days before your next scheduled visit. We can also pause service for vacations or seasonal reasons; ask us and we will work something out. We reserve the right to end service if the account is significantly past due, if the property is unsafe to service, or if the working relationship has broken down.
Communications
When you contact us or become a customer, we may call, text, or email you about your service, scheduling, invoices, and occasional company updates. Message and data rates may apply. You can opt out of marketing emails using the unsubscribe link, and reply STOP to any text message to stop future texts.
Website use
You may use our website for personal, non-commercial purposes to learn about our services and contact us. You agree not to interfere with the site, attempt to access it in unauthorized ways, or use it to send spam or harmful content. Site content, logos, and images are owned by Diamond Pool or our licensors and are protected by applicable laws.
Third-party tools and links
Our website uses third-party tools for analytics, forms, and marketing (which may include, but are not limited to, Google Tag Manager, Google Analytics, GoHighLevel, and the Meta Pixel). Those providers have their own terms and privacy practices. Links to third-party sites are provided for convenience and are not endorsements.
Disclaimers
Our website and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Diamond Pool Cleaning & Repair, including its owners and employees, is not liable for indirect, incidental, special, or consequential damages arising from your use of the website or our services. Our total liability for any claim relating to a specific service is limited to the amount you paid for that service in the three months prior to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold Diamond Pool harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the website, your violation of these Terms, or your violation of any law or third-party right.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona.
Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent changes. Continued use of our website or services after an update means you accept the revised Terms.
